Terms and Conditions

ACKNOWLEDGMENT AND ACCEPTANCE

By proceeding with your application and advancing to the next screen, you acknowledge that you have read,
understood, and agreed to the terms and conditions outlined below.

ASSUMPTION OF RISK

The crane industry presents inherent risks. Working with, on, or around cranes is dangerous, and errors can result in serious injury or fatality. California Crane School dba American Crane School provides a condensed test preparation course to assist candidates in passing the crane operator certification written exams and offers practical exam opportunities, subject to crane availability and weather conditions. This course is NOT a substitute for a crane apprenticeship program or comprehensive safety training. Candidates must adhere to all manufacturer instructions, as well as state and federal regulations, and should be familiar with the operator manuals and load charts for the specific cranes they will operate.

ENROLLMENT AND PAYMENT POLICY

1. Deposit and Payment

  • A non-refundable deposit of $500 is required at the time of registration.
  • The remaining balance is due two weeks before the first day of class. If not paid, your spot may be forfeited or rescheduled.
  • If you do not attend the course after paying the deposit, all fees will be forfeited. To enroll in a future session, an additional $500 deposit will be required.

2. Rescheduling

  • Candidates must provide at least two weeks’ notice via phone or email to reschedule a class.
  • A $150 rescheduling fee applies for each change.
  • Exceptions may be granted for documented work-related conflicts or medical emergencies.
  • Candidates may reschedule a maximum of two times before a new deposit and full payment are required.

3. Cancellation Policy

  • If a candidate cancels a class, all payments will be refunded, excluding the non-refundable $500 deposit.
  • Cancellations made after the deposit has been paid will result in forfeiture of the deposit.

4. Practice Time And Exam Fees

  • Additional practice time must be paid in full and is non-refundable even if unused.
  • If a candidate chooses to delay taking the Practical Exam, a $160 fee will be required to schedule a new test date.

5. Certification Results

  • Results will be sent directly from NCCCO once all scoring is complete.
  • Successful candidates will receive a certification card at their registered address.

GENERAL PROVISIONS

1. No Other Agreements

  • These terms constitute the entire agreement between the parties and supersede any prior written or oral agreements. No additional warranties or representations apply.

2. Indemnification

  • To the fullest extent permitted by law, candidates shall indemnify and hold harmless California Crane School dba American Crane School, its agents, and employees from any claims, damages, or losses arising from participation in the program, except where negligence by California Crane School dba American Crane School is established.

3. Force Majeure

  • California Crane School dba American Crane School is not liable for delays or cancellations due to strikes, labor disputes, adverse weather, acts of God, equipment failure, or other uncontrollable circumstances.

4. Governing Law and Jurisdiction

  • This agreement shall be governed by the laws of the States of California and Texas.
  • Any disputes must be resolved in the Superior Courts of Sacramento County, California, or the appropriate courts in Texas.

OPERATIONAL PROVISIONS

1. Candidates agree to operate cranes in compliance with all relevant regulations, manufacturer guidelines, and industry
standards.

2. Candidates must not exceed the manufacturer’s rated load capacities.

PAYMENT TERMS

1. Late Payments and Fees

  • Payments must be made within 15 days of the invoice date. A 1.5% monthly finance charge (18% APR) will be applied to overdue balances.
  • Late or unpaid balances may incur an additional 25% collection fee, plus court costs and attorney fees.
  • A $50 fee applies for NSF (Non-Sufficient Funds) checks.

2. Taxes and Additional Charges

  •  Any applicable state, federal, or local taxes are the responsibility of the customer and must be paid in addition to the agreed course fees.
